Lingutor Terms & Conditions

Welcome to Lingutor! These Terms & Conditions (“Terms”) govern your use of Lingutor’s platform, services, and applications (collectively, the “Services”). By accessing or using our Services, you agree to comply with these Terms. If you do not agree, you should not use the Services.

1. Definitions

• Lingutor / Company / We / Us: Lingutor, a platform for gamified vocabulary learning designed for schools, teachers, and students.
• User / You: Any individual using the Services, including teachers, students, and parents.
• Content: Any materials created, uploaded, shared, or displayed on the Services, including lessons, photos, word lists, or game progress.
• Account: Your personal account for accessing the Services, which may be of different types depending on your role (teacher, student, parent).

2. Account Registration & Responsibilities

• Users must register for an account to access most features of Lingutor.
• Teacher accounts are intended for classroom management, lesson creation, and progress monitoring.
• Student accounts are intended for personal vocabulary learning and game-based activities.
• You are responsible for providing accurate information during registration and updating it as necessary.
• You are responsible for maintaining the security and confidentiality of your account credentials.
• You are responsible for all activity performed under your account.
• You must notify us immediately of any unauthorized use of your account.
• You are responsible for the information uploaded by the student invited to join the class. If the student is younger than the age required under the GDPR to provide consent independently, you must obtain consent from the school or the parents.

3. Services Provided

Lingutor provides the following features:

• Educational Games: 14 gamified games designed to help students learn and retain vocabulary.
• Lesson Management: Teachers can create classes, assign lessons, or use ready-made lessons.
• Photo Scan: Teachers and students can turn any photo or textbook page into a lesson automatically.
• Smart Study: Adaptive learning paths with A1–C1 level word lists, spaced repetition, and pronunciation support.
• Custom Lessons: Teachers can create custom lessons tailored to students’ needs.
• Progress Tracking & Statistics: Detailed analytics of student performance, exportable for parent meetings.

Lingutor may enhance, modify, or discontinue any feature at any time without prior notice.

4. Subscription Plans & Payments

• Some features require a subscription or one-time purchase.
• Payment must be made through secure, third-party payment providers. Lingutor does not store full payment details.
• By subscribing, you authorize recurring billing if applicable, until cancellation.
• Subscription fees are non-refundable except as provided in our refund policy.

5. Refunds & Cancellations

• You may request a refund within 14 days of purchase if there is a technical or service-related issue.
• Refund requests are evaluated on a case-by-case basis.
• Canceling a subscription prevents future charges but does not refund payments already made.
• In the case of abuse, fraud, or violation of these Terms, refunds may be denied.

6. User Content & Intellectual Property

• Teachers retain ownership of the lessons and materials they create.
• By uploading content, you grant Lingutor a non-exclusive, worldwide, royalty-free license to display, store, and use the content solely for the purpose of providing the Services.
• Users must not upload content that violates copyright, trademark, or any other third-party rights.
• Users are responsible for the legality of the content they upload or share.
• Lingutor may remove any content that violates these Terms or is deemed inappropriate.

7. Acceptable Use Policy

You agree not to:

• Upload content that is illegal, harmful, offensive, or discriminatory.
• Harass, threaten, or harm other users.
• Attempt to gain unauthorized access to other accounts or systems.
• Use the Services for commercial purposes outside of the educational scope provided.
• Interfere with the proper functioning of the Services, including overloading servers or introducing malicious code.

8. Data Privacy & Security

• Lingutor processes personal data according to our Privacy Policy.
• Teachers, students, and parents have access to limited data necessary for educational purposes.
• Personal data may include name, email, class information, and study progress.
• We implement technical and organizational measures to protect personal data against unauthorized access, loss, or misuse.
• By using Lingutor, you consent to the collection and use of your personal data as described.

If you are unable to agree to the Privacy Policy and Terms & Conditions yourself due to being underage, your parents or guardians must agree to the services. When installing the app on your phone, you will need to select your age, and if it is insufficient, we will ask you to enter your parents' email address, to which all necessary information will be sent.

9. Limitation of Liability

• Lingutor provides the Services “as is” and does not guarantee uninterrupted or error-free operation.
• We are not liable for indirect, incidental, or consequential damages, including data loss, even if we were advised of the possibility.
• You use the Services at your own risk and are responsible for maintaining backups of your content.

10. Termination of Service

• Lingutor may suspend or terminate accounts for violations of these Terms, including illegal activity or misuse of the platform.
• Users can delete their account at any time, provided that it does not conflict with the information set out in the Privacy Policy.
• Certain data may remain in backups or archives for legal or operational purposes, even after account deletion.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which Lingutor is incorporated. Any disputes shall be resolved in accordance with applicable law.

12. Updates to Terms

• Lingutor may update these Terms periodically to reflect changes in our Services or legal requirements.
• The updated Terms will be published on the Lingutor website, and continued use of the Services constitutes acceptance of the new Terms.
